The trustee sale for 18 Tortoise Shell was scheduled for 12/23/09, but the trustee sale was canceled. Most cancellations of trustee are due to a loan modification or a loan modification in process, but there is no way for us at the CHB to know for sure which cancellations are due to a loan mod because loan mods are not recorded, whereas loan refinancings are recorded. Anywhooz, a new NTS was recorded soon after the cancellation, was scheduled for 2/23/10, and has since been postponed until 4/14/10.
18 Tortoise Shell was sold by the builder in November of 2000 to it’s present owner for $960,000 with a 1st mortgage for only $150,000. That is what the records show. A few refi’s and 9 years later and there is a 1st with an original loan amount for $1,290,000, a 2nd for $785,000, and another loan for $10,000 recording on 1/04/10.
18 Tortoise Shell has been listed, delisted, relisted and had the price changed about 29 times since September of 2007. The CZ Master Associtation also filed an NOD on 18 Tortoise Shell, and it does not seem to be listed presently. If I had to guess, I would say a short sale is in the works.

I showed this house to a couple of clients back a couple of years ago. It had at least one invisible issue, which became apparent, when digging deeper. A big one, was a story/rumor/actual fact shared by the entire street – on this side – about a flooding issue from the creek behind the houses.
The street bows a bit in the middle – and at the bottom of that bow there was at least one house – which may not have been properly sealed, whatever that means, and during a rainy season, water began to percolate up through the floor of either the house, or the garage, or both.
From what I heard, Toll Brothers actually had to buy that house back, and may have had to rebuild it – correctly. As a prospective buyer’s agent I was given paperwork from a lawsuit that resulted, and that made my buyer and me, understandably skittish, even though this house sits about 20′ higher, over the creek, than the rebuilt house was.
That is just the type of information which has to be disclosed on such a property.
